Termination of labor contracts under the labor code 2012 – some limitations and improvement guidelines

Abstract

Termination of labor contracts is an inevitable issue in any organizations. This is an important issue that affects the rights and legitimate interests of both workers and employers. The practice of resolving labor disputes in Vietnam reveals that the majority of labor disputes are related to the termination of labor contracts. This study analyzes some of the bottlenecks, limitations, the lack of feasibility in the legislation on termination of labor contracts, and proposes some recommendations to improve these regulations and the efficiency of enforcement.
